What To Do If You’re Arrested With Someone Else’s Drugs in the Car

This is a VERY common situation:

You’re riding with friends…
You get pulled over…
Drugs are found…
Suddenly everyone in the car is charged.

This happens constantly in Arkansas, and many people panic thinking they’re automatically guilty.

Here’s the truth: You are NOT automatically responsible for someone else’s drugs.

1. Arkansas Uses “Constructive Possession” in These Cases

The State must prove:

  • you knew the drugs were present, AND

  • you had control over the area where they were found.

Being in the same car is not enough.

2. Factors That Help the Defense

You may have a strong defense if:

  • the drugs were in someone else’s bag

  • the drugs were found closer to another person

  • your fingerprints were not on anything

  • someone else admitted ownership

  • the officer cannot show knowledge

  • you were a passenger, not the driver

  • you were in a rideshare or borrowed vehicle

These cases are often highly defensible.

3. You Should NOT Try to Explain Yourself on the Scene

People often say things that hurt their case, even when they’re innocent.

Statements like:

  • “Those aren’t mine.”

  • “I didn’t know they were there.”

…sound helpful, but the State may twist them.

Stay silent and ask for a lawyer.

4. A Skilled Attorney Can Get These Cases Thrown Out
